In the back ground of land dispute, it has been alleged by the informant that Md. Mohid (petitioner), Md. Jamshed and Samsa Khatoon made house trespass and then, took his son Md. Insad aged about one year from the lap of his wife Rabina Khatoon, threw him on the ground and then throttled. Though throttling has been shown to be cause of death in the postmortem report but from the statement of the informant as well as his wife (para-4 and para-5), it is evident that they failed to identify an individual to be the culprit.

Consequent thereupon, the petitioner Md. Mohid is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.4404 of 2020(6) dt.15-06-2020 2/2 each to the satisfaction of the S.D.J.M., Udakishunganj, Madhepura in Chausa P.S.Case No. 332/2018, G.R.Case No. 1504/2018.
