Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Kishanpur P.S. Case No. 242 of 2016 registered for offence punishable under sections 147, 148, 149, 341, 323, 324, 307, 504, 506 and 379 of the Indian Penal Code.

As per allegation, the accuse persons assaulted the informant. The allegation against co-accused Kapil Yadav is that he assaulted him on his leg.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.13480 of 2021(4) dt.17-05-2022 2/2 that the petitioner is innocent and a person of clean antecedent. He has submitted further that co-accused Dilip Yadav @ Dilip Kumar has been granted anticipatory bail in Cr. Misc. No.13195 of 2021 by this Court and the case of the petitioner is on similar footing of co-accused Dilip Yadav.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Supaul in connection with Kishanpur P.S. Case No. 242 of 2016, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
