JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 24.07.2015 in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 8, 20 and 22 of the NDPS Act. It is alleged that when one person was robbed by administering some intoxicant while travelling by train, raid was laid when petitioner and one Jahangir Alam were arrested. From Jahangir Alam, one stripe of Ativan tablet containing 15 tablets and other articles were recovered whereas from the petitioner, articles of day-to-day use were recovered.

It is submitted by learned counsel for the petitioner that only on suspicion, the petitioner has been apprehended. Moreover, investigation has already concluded. A statement has been made in para 3 of the petition that the petitioner has no criminal

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ, 3rd, Katihar in connection with Kishanganj Rail P.S. Case No. 16 of 2015.
