The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 409, 420 of the Indian Penal Code and section 45 of Bihar Co-operative Society Act.
Prosecution case relates to embezzlement of government fund by the petitioner as he omitted the audit while he was PACS Chairman. It is a case of financial irregularities. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. In fact, petitioner has handed over the entire register regarding Srikhinda PACS and has given the charge to the present Secretary in the year 2010-20211. There is inordinate delay in
Patna High Court CR. MISC. No.3064 of 2023(2) dt.03-04-2023 2/2 lodging the FIR without any plausible explanation. Petitioner is languishing in judicial custody since 26.06.2022. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM, Sasaram, Rohtas in connection with Baghaila P.S. Case No. 86 of 2018.
