The petitioner seeks regular bail in connection with Barhat P.S. Case No. 58 of 2019 for the offence punishable under Sections 25(1-b)A, 26 of the Arms Act.

The allegation is regarding recovery of two country made pistol and seven live cartridges from the possession of the petitioner herein, after he was apprehended by the police and search was made.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is languishing in custody since 20.06.2019.

Having regard to the facts and circumstances of the

No.1234 of 2020(2) dt.20-01-2020 2/2 case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct for release of the petitioner immediately upon completion of nine months of his custody i.e. w.e.f. 20.06.2019 and further subject to such condition as may be imposed by the learned court of Judicial Magistrate-1st Class, Jamui in connection with Barhat P.S. Case No. 58 of 2019.

The petition stands disposed of with the aforesaid observations and directions.
