ANJANA MISHRA ORAL ORDER 20-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.07.2019 in connection with Naubatpur P.S. Case No.484 of 2019 registered for the offence under Sections 25(1-b)a/26/35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner was arrested on false premise from Punpun Railway Station stating that certain arms had been recovered from the house of the petitioner. Learned counsel further submits that the house from which such recoveries are alleged to have been made are joint possession of the family and therefore cannot be saddled on his shoulders.
