JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 21.05.2015 Supplementary affidavit is filed on behalf of the petitioner. Heard learned counsel for the petitioner, learned Addl. Public Prosecutor for the State as well as learned counsel for the informant.

Petitioner is not assailant of the deceased and it is stated that he along with co-accused Tinku and Azam assaulted the informant by means of rod and fists. Informant sustained two injuries on his forehead. Co-accused Tinku and Azam have already been granted privilege of bail by different benches of this court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Siwan in Sessions trial no. 03/2015 arising out of Barhariya (G.B. Nagar) P.S. Case no. 304/2014.
