Petitioner seeks regular bail in connection with Jehanabad PS Case No. 373 of 2021 registered for the offence under Sections 457 / 380 of the IPC.

Petitioner was caught red handed while committing theft in the house of the informant. The accomplice of the petitioner however succeeded in fleeing away with the stolen property, cloth and cash Rs. 20000/- etc.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and has not committed any offence in the manner alleged. The petitioner has not been caught along with looted property. The petitioner is in custody since 13-06-2021 and charge sheet has already been submitted.

No.3012 of 2022(2) dt.26-05-2022 2/2 Regard being had to the submissions made by the parties, taking into consideration period of custody of the petitioner i.e. since 13-06-2021 and the fact that charge sheet has already been submitted, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad PS Case No. 373 of 2021 on the following condition:- (a) that the petitioner shall remain present on each and every date during the course of trial and in case of default on two consecutive dates on the part of the petitioner, his bail bond shall liable to be cancelled.
