JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Jakkanpur P.S. Case No. 297 of 2019 registered for the offences punishable under Sections 406, 420, 379, 377/34 of the Indian Penal Code.

The informant claims herself to be transgender but she states that on 15.08.2017 petitioner took the informant in a house where he committed unnatural sex with him. However, petitioner with the help of her other family members got solemnized his marriage with the informant forcibly and after that snatched her entire income and assaulted her as well as ousted her from his house.

Initially, informant filed Complaint Case on

Patna High Court CR. MISC. No.1391 of 2020(2) dt.27-02-2020 2/2 16.03.2019 which was converted into police case. The complaint petition itself, goes to show that so called sexual assault was made in the year 2017 and the complaint was filed in the year 2019.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate- Patna in Jakkanpur P.S. Case No. 297 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
