====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR ORAL ORDER 20-07-2026 Heard learned counsel for the petitioner and learned counsel for the State.

In the instant writ petition, the petitioner has prayed for the following reliefs:- " This is an application for issuance of an appropriate Writ/Writs, Direction/Directions to the respondent authority to pay ex-gratia amount of Rs 4,50,000/= (Four lac fifty thousand Rupees only) due to death of the husband of the petitioner on account of
Patna High Court CWJC No.970 of 2024(10) dt.20-07-2026 2/3 Covid 19 as provided under the guideline issued by the Central Government for paying the compensation of Ex-Gratia of Covid -19 Victim. and/or pass any order/ orders, direction / s for which the petitioner is found legally entitled."

Learned counsel for the petitioner submits that in spite of issuance of specific guidelines for providing ex-gratia to the dependent of the Covid -19 victim and having prefer medical evidence and several representation to the concerned authorities, no action had been taken in respect to payment of compensation.

Learned counsel for the State referring to the counter affidavit of the respondent no. 5 District Magistrate, Buxar submits that in compliance of the order of this Hon'ble Court, three men committee was set up and an inquiry was made. In the course of inquiry, Director V.K. Global Hospital Buxar was examined and as per his declaration, it was found that Lalit Kumar, the husband of the petitioner was diagnosed as Covid-19 negative.
5. Having heard the parties, in view of the aforesaid fact where authorities are denying the fact that the husband of the petitioner was suffering from Covid-19. I am not inclined to
Patna High Court CWJC No.970 of 2024(10) dt.20-07-2026 3/3 interfere in the present writ petition. However, the petitioner is at liberty to file representation before authorities concerned for payment of Ex-Gratia with all relevant documents.
6. It is made clear that if such representation is being made, authorities concerned shall look into the matter sympathetically and do the needful.
7. With the aforesaid observation, the present writ petition is disposed of.
