JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 The petitioner seeks regular bail in connection with Sherghati P.S. Case No. 47 of 2019, registered for offences punishable under Sections 25(1-b)a, 36 and 35 of the Arms Act. Allegation is of recovery of one loaded rifle and one live cartridge from the possession of the petitioner. Apart from that petitioner is accused in two more cases. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered from the possession of the petitioner and he has been in judicial custody since 11.02.2019.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand)

Patna High Court CR. MISC. No.936 of 2020(2) dt.16-01-2020 2/2 with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Sherghati P.S. Case No. 47 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
