The grievance of the petitioner is in a limited bound to the extent that despite the challenge being made to the impugned order of his termination contained in Memo No.1386 dated 07.09.2019 before the Regional Deputy Director, Munger in a duly preferred appeal, the same has not been disposed off till date. A copy of the memo of appeal has been brought on record as Annexure-P/2.

3. Learned Advocate for the petitioner submitted that earlier the petitioner had come before this Court in C.W.J.C. No.13550 of 2019 seeking a direction upon the respondent(s) for acceptance of his joining on account of becoming medically fit; however, instead of accepting his joining, the services of the petitioner came to be terminated. The order of termination came to be challenged in appeal but till date no order has been passed, thus the petitioner has approached this Court by challenging the order of termination and alternatively seeking a prayer for disposal of the appeal.

4. Learned Advocate for the State submitted that admittedly the services of the petitioner came to be terminated long back in the year 2019 by a reasoned order (Annexure-P/1), the present writ petition has been filed after a delay of five years.

5. Having considered the submissions advanced and taking note of the fact that the petitioner has already been preferred appeal (Annexure-P/2) against the order of termination, the same must be brought to its logical conclusion. Accordingly, the present writ petition stands disposed off with a direction to respondent no.3, the Regional Deputy Director (Education), Munger Division, Munger to consider and dispose
