The petitioner seeks bail in Sadar Hajipur P.S. Case No. 394 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant made very specific allegation that the petitioner assaulted his brother Arvind with sickle. From the injury report it appears that half portion of abdomen of Arvind was cut and the injuries opined to be grievous in nature. Learned counsel for the petitioner submits that the name of Arvind is also Mugal Kumar, but Mugal Kumar did not get such injury. The doctor also examined Mugal Kumar, but injury was found on the head of Mugal Kumar.

Considering the facts aforesaid and the fact that the

No.7370 of 2015 (4) dt.01-05-2015 2/2 informant made very specific allegation that the petitioner assaulted his brother Arvind with sickle in his abdomen and the injury is grievous in nature, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected. The trial court is directed to expedite the trial and conclude the same within six months from the date of receipt/production of a copy of this order, if the trial is not concluded, the petitioner may renew his prayer for bail firstly before the court below.
