The petitioner is languishing in custody since 13.12.2018 in a case registered for the offences punishable under Sections 30(a) and 37(b) of the Bihar Prohibition and Excise Act, 2016. It is alleged that from the glossary shop of the informant, 20 liters of country made illicit liquor were recovered. It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family shop. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the recovery has been made from the shop of the petitioner.

Considering the quantity of recovery and the period in custody, coupled with the fact that petitioner is not having criminal antecedent, let the petitioner above named be released on bail on

Patna High Court Cr.Misc. No.4183 of 2019(2) dt.28-01-2019 2/2 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ II-cum-Special Judge, Katihar in connection with Falka P.S. Case No. 484 of 2018.
