This writ application has been filed by the petitioner for payment of retiral dues i.e. leave encashment, group insurance, arrears of salary as well as benefit of ACP, revised pension and gratuity and other retiral dues.

Petitioner was appointed as junior engineer on 18.04.1991 in the Road Construction Department and thereafter his services were transferred to the Rural Works Department on

Patna High Court CWJC No.16580 of 2018 dt.15-06-2020 2/3 30.06.1995 from where he retired on 30.09.2015 from the post of Junior Engineer from Tarapur Block, Munger. Counter affidavit has been filed on behalf of respondents in which it has been stated that grievances of petitioner has been redressed and all dues i.e. leave encashment, group insurance, arrears of salary has been paid. Petitioner has been granted first ACP and second ACP and pension and gratuity were revised and differential amount paid which has been admitted by the counsel for the petitioner. However, it was submitted that no interest on delayed payment has been made. 5% interest per annum on delayed payment of retiral dues is to be made in terms of circular issued by the Finance Department Govt. of Bihar, dated 7.11.1987.

This writ petition is disposed of with a direction to the petitioner to file a representation before the concerned authority for interest on delayed payment over retiral dues and same shall be decided by the concerned authority in terms of circular dated 07.11.1987 of Finance Department as referred above, within two months from the date of receipt/production of a copy of the order passed by this Court and if petitioner is found entitled for interest on delayed payment same to be paid to the petitioner within two months thereafter.
