2. In this writ petition, limited prayer has been made by the petitioners for a direction to respondent no.3-Sub

Patna High Court CWJC No.1099 of 2017 dt.24-11-2022 2/3 Divisional Magistrate, Phulparas District- Madhubani to pass order in Miscellaneous Case No.05 of 2002 in light of remand order dated 21.10.2008/26.12.2008 passed in Miscellaneous Case No.61 of 2004-05 by respondent no.2-Collector, Madhubani.

3. Neither learned counsel for the State nor learned counsel for the private respondents object to this simple prayer of the petitioners.

4. This Court directs the respondent no.3-Sub Divisional Magistrate, Phulparas, District- Madhubani to dispose of Miscellaneous Case No.05 of 2002 in accordance with law after hearing all the affected parties within six weeks from the date of production/receipt of a copy of this order. While disposing the Miscellaneous Case No.05 of 2002 the respondent no.3-Sub Division Magistrate, Phulparas, DistrictMadhubani will act as per remand order dated 21.10.2008/26.12.2008 passed in Miscellaneous Case No. 61 of 2004-05.

5. With the aforesaid observations and directions, this writ petition stands disposed of.
