JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 08-05-2015 Heard learned counsel for the parties.
The petitioner is an accused in a case under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that the F.I.R. was against unknown persons. He further submits that there is no concrete evidence that petitioner has committed the crime. Earlier the petitioner was granted provisional bail on 21.04.2008 for a week, however, he misused the privilege of provisional bail and thereafter he was apprehended and remanded in this case on 29.04.2014. He further submits that by now petitioner has put more than one year in custody. Learned counsel further submits that in other cases, the petitioner has been granted bail. No.6681 of 2015 (2) dt.08-05-2015 2 / 2 petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar-IV, Judicial Magistrate, 1st Class, Patna City, Patna in connection with Chowk P.S. Case No. 205 of 2007, with the following conditions. (i) One of the bailors would be his own family members.
(ii) The petitioner would report to the nearby police station once every two months.
