The petitioner has filed the instant application for grant of regular bail in connection with Sheohar P.S. Case No. 171 of 2017 registered under sections 419, 420, 468 and 120B of the Indian Penal Code.
Allegation against the co-accused persons including this petitioner is of cheating of ten lakhs.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner is not named in F.I.R. rather his name came into light in this case on
Patna High Court CR. MISC. No.2774 of 2023(2) dt.03-04-2023 2/3 the basis of confessional statement of other co-accused person, namely, Moti Kumar before the police. It is further submitted that ten lakhs was deposited in the account of coaccused Rajeev Ranjan not in the account of this petitioner. He has no concern either with the alleged offence or with the co-accused Rajeev Ranjan who has already been granted bail by the different co-ordinate Bench of this Court vide order dated 19.03.2018 in Cr. Misc. No. 8654 of 2018 and several other co-accused persons have also been granted bail vide Annexure-2, 3 and 4 of this petition. During investigation, no any cogent material came against the petitioner to implicate in this case. He is languishing in judicial custody since 05.04.2022.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Sheohar P.S. Case No. 171 of 2017 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the
