JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-05-2015 Petitioner is languishing in custody since 01.02.2015 in a case registered for the offences punishable under Sections 11(1)(a)(d)(k) of Prevention of Cruelty to Animals Act, 1960.
I.A. No. 577 of 2015 has been filed for grant of bail to the petitioner since the marriage of the daughter of the petitioner is to be solemnized on 10.05.2015. The accusation is smuggling the animals to Nepal.
It is submitted by learned counsel for the petitioner that petitioner has been roped in the present case since the petitioner has filed a writ application being C.W.J.C. No. 1700 of 2012 against the police officials for not allowing him to carry the business of animals.
Considering the nature of accusation and the fact that investigation has already concluded, let the petitioner,
Patna High Court Cr.Misc. No.12257 of 2015 (2) dt.01-05-2015 2/2 above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bettiah, West Champaran in connection with Balthar P.S. Case No. 7 of 2015.
Since the petitioner is accused in thirteen cases, let learned Court below positively cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in some serious nature of offence or defaults for three consecutive occasions during trial.
