Petitioner is apprehending her arrest in connection with Nokha P.S.Case No133 of 2019 (POCSO Case No.118 of 2019) , registered for offences punishable under Sections 376, 314 and 120(B) of the Indian Penal Code and Section 4 of the POCSO Act..
As per FIR, there was allegation of having sexual intercourse against one co-accused on the assurance of marriage and thereafter she became pregnant and her pregnancy was miscarriage and later on co-accused refused to marry with her.
Submission of the learned counsel for the petitioner is that petitioner is not named in the FIR. Even the allegation is
Patna High Court CR. MISC. No.2941 of 2020(2) dt.24-01-2020 2/2 against another co-accused and she is ready to co-operate in the investigation.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge, Rohtas at Sasaram in connection with Nokha P.S.case No133 of 2019 (POCSO Case no.118 of 2019), subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
