The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
100 litres of country made liquor has been recovered from near canal and 200 litres of Mahua and Jaggery solution has been destroyed at the place of recovery by the police. It is submitted that petitioner has falsely been implicated in this case only on suspicion. Name of petitioner transpired in this case during course of investigation on the basis statement of Chaukidar. Nothing has been recovered from conscious possession of this petitioner. Petitioner has got no criminal antecedent of similar nature.

No.3644 of 2023(2) dt.03-04-2023 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court- 2, Nawada in connection with Warisaliganj P.S. Case No. 698 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
