The petitioner is languishing in custody since 12.06.2014 in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. A truck loaded with hundred bundle of rubber worth Rs.25,45,000/- was robbed by ten miscreants. The FIR was lodged against unknown. The name of the petitioner sprang up during investigation.

A statement has been made in para 7 of the petition that neither there is any recovery from the petitioner nor the petitioner has been put on TIP till date. Considering the aforesaid facts, let the above

Patna High Court Cr.Misc. No.9202 of 2015 (02) dt.17-03-2015 2/2 named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Muzaffarpur in connection with Gaighat P.S. Case No. 73 of 2013. Since the petitioner has serious criminal antecedent, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
