2. The petitioner seeks bail in connection with Jehanabad P.S. Case No. 1046 of 2025 dated 09.10.2025, registered for the offence under Sections 126(2), 115(2), 109, 118(1), 352, 351(2), 3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the petitioner and coaccused Lakshman Sao are alleged to have inflicted knife blows on Sujal Kumar, son of the informant as a result of which he became unconscious and fell on the ground, thereafter he was taken to Sadar Hospital, Jehanabad, and from there he was referred to P.M.C.H., Patna for further treatment.
4. Learned counsel appearing for the petitioner has submitted that the parties are own brothers and a title suit is
Patna High Court CR. MISC. No.4175 of 2026(4) dt.05-05-2026 2/3 pending between them as regards partition of the ancestral property. He has further submitted that there appears to be no injury report of the injured persons on record and there are only prescription of their treatment. There is case and counter case between the parties. It has been submitted that the informant side were the aggressor. The petitioner is in custody since 11.10.2025 and he is accused in one another case which was lodged by the prosecution party itself in which he is on bail. It has lastly been submitted that charge-sheet has been filed in this case and there is no allegation of tampering and similarly situated co-accused Lakshman Sao has been granted the privilege of bail by this Court by order dated 28.04.2026 passed in Cr. Misc. No. 8018 of 2026.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the prayer for bail of the petitioner. It has been submitted by learned counsel for the informant that they are trying to disturb the peace and tranquility whenever the informant side goes to the property they are threatened and are also being assaulted.
6. Heard learned counsel for the parties and perused the record.
7. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.4175 of 2026(4) dt.05-05-2026 3/3 case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad P.S. Case No. 1046 of 2025.
