The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 326, 307, 302 of IPC.

It is submitted that there is general and omnibus allegation against the petitioner to have assaulted the deceased. The petitioner is alleged to have been armed with lathi.

It is further submitted that 12 persons including the petitioner are alleged to have assaulted the informant, his brother and father. The petitioner has been falsely implicated in this case due to land dispute. After investigation chargesheet has already been submitted against the petitioner and there is no chance of tampering with the witnesses. The

Patna High Court Cr.Misc. No.8906 of 2015 (5) dt.22-06-2015 2/2 petitioner has been in custody since 6.10.2014. Learned counsel for the State submits that after investigation the case has been found true against the petitioner also and he has also criminal antecedent. Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Randhir Kumar, learned Judicial Magistrate, 1st Class, Banka/court concerned in Katoria P. S. Case No. 53 of 2014 after framing of charge with following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
