JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 23.11.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 307, 380, 427 and 504 of the Indian Penal Code.

It is alleged against the petitioner that he assaulted the informant with farsa. The injury has been found to be grievous. It is submitted by learned counsel for the petitioner that there is no accusation of repeating the blow. The FIR reflects that the accusation against the petitioner has subsequently been added in the FIR with different ink. There is counter version of the occurrence also and petitioner's side also received injuries. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

No.7449 of 2015 (2) dt.02-03-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Saharsa in connection with Mahishi P.S. Case No. 156 of 2014.
