JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-02-2019 The present writ petition has been filed to direct the respondents to allow the petitioner to work as Sweeper in M.L. Academy High School, Laheriyasarai, Darbhanga. The learned counsel for the respondents has submitted that one person having identical name as that of petitioner had died and thereafter his son has already been appointed on compassionate ground. As far as the petitioner is concerned, he is said to be claiming to be the aforesaid person, who had died. The present writ petition admittedly contains disputed question of facts which cannot be adjudicated by this Court under writ jurisdiction under Article 226 of the Constitution of India.

Patna High Court CWJC No.16585 of 2018(2) dt.14-02-2019 2/2 Having regard to the disputed question of facts involved in the present writ petition, the learned counsel for the petitioner seeks to avail such other remedies as are available under the law and according to him, he has already filed a petition before the District Education Officer, Darbhanga, hence he seeks liberty to pursue the same.

Accordingly, the present writ petition is disposed off as withdrawn with liberty to the petitioner to pursue such other remedies as are available under the law including the representation which he has filed before the District Education Officer, Darbhanga.
