ANJANA MISHRA ORAL ORDER 26-05-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 11.9.2014 in connection with Sessions Trial No.17 of 2015, arising out of Sakra P.S. Case No.409 of 2014, registered for the offences under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the case is one of false implication and the petitioner is an old man of 80 years of age and there is also a history of land dispute. It is further submitted that the injury found on the person of the deceased also belies the prosecution case as though it is alleged that there was continuous assaults by the petitioner and others, yet only one injury was found on the person of the deceased.
