JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 23-09-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Vide order dated 07.07.2021, a report was called in this case regarding the stage of trial. In compliance thereof, a report kept at Flag 'A' dated 24.07.2021 has been sent by the learned Additional Sessions Judge-IInd, Muzaffarpur stating therein that charge has been framed against the petitioner on 09.05.2019 and the trial is pending for prosecution evidence. Apart from the I.O. and doctor, out of eight charge sheet witnesses, six witnesses have been examined and only two witnesses have not yet been examined and non-bailable warrant has been issued against them. It is hoped that the trial would be concluded in five months.

Accordingly the bail application of the petitioner is hereby dismissed.

However, the learned trial court is directed to conclude the trial as expeditiously as possible, preferably within a period of six months from the date of production of a copy of this order.

The petitioner and other concerned shall co-operate in the trial.

The Superintendent of Police, Muzaffarpur is directed to take steps for production of rest of the prosecution witnesses for their examination, as and when the date is fixed, so that the trial may be concluded within the time indicated herein above. (Anjani Kumar Sharan, J) pallavi/- U T
