JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 19.09.2015 in a case registered under section 376 read with section 511 of the Indian Penal Code on the accusation that he made attempt to commit rape on informant's wife who was sleeping at the roof of the house at the time of alleged occurrence.

Submission on behalf of the petitioner is that the informant and petitioner were good friends and as a matter of fact, the informant had taken some loan from the petitioner and when the petitioner pressurized to return the money, the informant got instituted this false case.

Considering the aforesaid facts and circumstances as

No.4594 of 2016 (2) dt.10-02-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Dhanarua P.S.Case No. 361 of 2015.
