The petitioner seeks regular bail in connection with Paroo P.S. Case No. 377 of 2019 lodged under Section 395 of the Indian Penal Code, 1860.
As per the prosecution, the F.I.R. has been filed against 7-8 unknown persons aged about 22 to 25 years. There is allegation of overpowered the informant and his brother on pistol point when they were going to their village. It has been alleged that accused persons tied their eyes, snatched their mobile and cash and ran away with the tobacco loaded pick up vehicle. It has also been alleged that accused persons have thrown them in chaur (strange place).
Learned counsel for the petitioner submits that present
Patna High Court CR. MISC. No.2958 of 2022(2) dt.13-06-2022 2/3 F.I.R. has been lodged against unknown persons of aged about 22 to 25 years. The name of the petitioner figured in this case due to confessional statement of co-accused. Nothing has been recovered from the conscious possession of the petitioner. As per information at Bar, T.I.P. has not taken place in this case till date. He further submits that charge sheet has already been filed in this case and petitioner is in custody since 01.07.2020. Learned counsel for the petitioner further submits that the accused has implicated in one criminal case in which he is on bail.
Learned A.P.P. has opposed the prayer for bail. In the present facts and circumstances of the case and for considering the submissions made by learned counsel, materials available on record and considering this aspect of the matter that charge sheet has already been filed, petitioner is in custody since 01.07.2020 and Co-ordinate Bench of this Court has granted bail to another co-accused vide order dated 30.03.2022 in Cr. Misc. No. 60917 of 2021 and vide order dt. 21.08.2021 passed in Cr. Misc. No.30357 of 2021, let the petitioner above named, be granted bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief
