JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The present case has been registered on the basis of complaint petition.
No doubt, petitioner is named in the F.I.R. on the accusation that he along with three other accused took the deceased and committed his murder but learned counsel for the petitioner drew my attention towards Annexure-2 and Annexure-3 of the petition and submitted that as a matter of fact the deceased met an accident and in respect of the aforesaid accident, a Sanha was lodged by the employee of railway.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.4285 of 2016 (3) dt.19-02-2016 2/2 well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., East Champaran, Motihari in connection with Pipra P.S. Case No.144 of 2014.
