Petitioner seeks regular bail in connection with Dhaka ( Pachpakari ) PS Case No. 453 / 2021 registered for the offence under Sections 393 of the IPC and Section 25 (1-b)a / 26 / 35 / 27 of the Arms Act.
In a bid of loot the informant caught hold the petitioner along with fire arm and three other accused persons succeeded in fleeing away. One country made pistol recovered from the petitioner has been handed over to police by the informant.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to some scuffle which had taken place between the informant and the petitioner when the motorcycle of the informant dashed the
Patna High Court CR. MISC. No.2754 of 2022(2) dt.26-05-2022 2/2 motorcycle of the petitioner. The petitioner is having no criminal antecedent, he is in custody since 15-09-2021 and charge sheet has already been submitted.
Regard being had to the submissions made by the parties, taking into consideration the material available on record, the fact that petitioner has got no criminal antecedent, he is in custody since 15-09-2021, charge sheet has already been submitted and there is no likelihood that petitioner will abscond or tamper with the evidence if released on bail, as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand ) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka District - East Champaran in connection with Dhaka (Pachpakari) PS Case No. 453 / 2021.
