The petitioner seeks bail in anticipation of his arrest in connection with Mokama P. S. Case No. 206 of 2018 dated 02.08.2018 instituted for the offences under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.

1980 litres of liquor is said to have been recovered from a Bolero vehicle. The name of the petitioner and others have transpired in the statement of witnesses. Learned counsel for the petitioner has submitted that he has falsely been implicated even when there has not been any recovery from his possession or his constructive possession. He enjoys a fair antecedent.

No.3821 of 2019(2) dt.25-01-2019 2/2 It has also been brought to the notice of this Court that one of the co-accused persons similarly situated has been granted anticipatory bail by a Bench of this Court. The petitioner also undertakes that he shall never claim the ownership of the vehicle in future. Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Mokama P. S. Case No. 206 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
