The petitioners are languishing in custody since 22.11.2018 in a case registered for the offences punishable under Section30(a) of the Bihar Prohibition and Excise Act, 2016.
It is alleged that form a D.C.M. truck, 660 litres of illicit country made liquor were recovered. The petitioners were the driver and cleaner of the truck in question. It is submitted by learned counsel for the petitioners that the petitioners were unaware about the liquor being loaded on the truck in question and the petitioners are not having any
Patna High Court Cr.Misc. No.6025 of 2019(2) dt.04-02-2019 2/2 criminal antecedent, statement to that effect has been made in paragraph 3 of the petition.
Learned APP submits that the recovery has been made from the truck of the petitioners.
Considering the fact that the prosecution report does not suggest the owner of the truck in question, period under custody and the fact that the petitioners are not having any criminal antecedent, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II -cum- Special Judge, Excise, Gopalganj in connection with Excise Case No. 275 of 2018.
