JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-07-2020 This application has been preferred for modification of the order dated 26.09.2019 passed in Cr. Misc. No. 46206 of 2019 seeking extension of time to surrender and submit bail bond in the learned court below in terms of the order passed by this Court.

On perusal of the application, it appears that the petitioner has taken a plea that he could not surrender within the prescribed period of four weeks pursuant to the order dated 26.07.2019 which was confirmed later on by this Court on 26.09.2019, because of his illness. In this connection, he has

Patna High Court CR. MISC. No.2730 of 2020(3) dt.07-07-2020 2/2 enclosed a Doctor's prescription showing that he was under treatment of Dr. Rajendra Prasad Roy since 25.10.2019 to 20.12.2019 suffering from jaundice.

In the given facts and circumstances of the case, in the interest of justice, this Court is extending the period to surrender and submit bail bond in terms of the order dated 26.07.2019 which has been confirmed later on by this Court by four weeks from today. In case the petitioner surrenders and submits his bail bond within four weeks from today, the privilege of anticipatory bail granted to him by aforesaid order shall continue otherwise the learned court below shall proceed with the matter in accordance with law.

It is made clear that no further modification shall be entertained.
