Earlier, the prayer for bail of the petitioner was twice rejected but petitioner is in jail custody since 08.02.2015 in a case registered under section 392 of the Indian Penal Code. The trial court has reported that charge has already been framed and summons has been issued to the witnesses but up till now, not a single prosecution witnesses could be examined. From perusal of the report of learned Judicial Magistrate1st class Chapra, it would appear that the concerned court has given a very vague report because he has not mentioned the date of framing of charge nor mentioned the number of prosecution witnesses. Moreover, it appears that there is no likelihood of conclusion of trial of the petitioner in near future and
Patna High Court Cr.Misc. No.7908 of 2016 (3) dt.13-07-2016 2/2 petitioner is in jail custody since 08.02.2015 without having any criminal antecedent.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Dariyapur P.S.Case No. 230 of 2014.
