Mr.Manoj Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-01-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Rajapakar P.S. Case No. 189 of 2018 registered for the offence punishable under Sections 341, 342, 379, 307, 504/34 of the Indian Penal Code.

The allegation in the present case is regarding the accused persons having assaulted the father of the informant. It is alleged that the co-accused, namely, Nand Kishore Singh had assaulted the father of the informant on his head by axe and thereafter the co-accused persons including the petitioner had had assaulted by lathi.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It

Patna High Court Cr.Misc. No.4083 of 2019(2) dt.25-01-2019 2/2 is further submitted that the petitioner has a clean antecedent and he is languishing in custody since 23.10.2018. Lastly, it is submitted that as per the injury report the injury received by the father of the informant on the head is said to be grievous in nature and rest are simple in nature and as far as the petitioner is concerned, it is not alleged that he had assaulted the father of the informant on his head, hence the grievous injury caused to the father of the informant is not attributable to the petitioner herein.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Rajapakar P.S. Case No. 189 of 2018.
