2. The petitioners seek pre-arrest bail in connection with Sultanganj P.S. Case No. 417/2024 registered for the offence(s) punishable under Sections 137(2), 351(2), 351(3) of BNS corresponding to Sections 363, 504 and 506 of the Indian Penal Code and Section 4 of POCSO Act.

3. As per the allegation made in the FIR, son of petitioner no.1 and brother of petitioner no.2, Suman Kumar had

4. Learned counsel appearing on behalf of the petitioners submitted that petitioner no.1 is mother and petitioner no.2 is the brother of co-accused Suman Kumar and they have no concern with the alleged offence committed by the co-accused Suman Kumar. He further submitted that petitioners have been implicated in the present case because they had refused to get the informant married with Suman Kumar. Petitioners are innocent and have clean antecedents.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the nature of allegation made against the petitioners that they had refused from getting the informant, who is victim, married with co-accused Suman Kumar and also the fact that informant has herself admitted that she is minor, I am of the opinion that petitioners have, prima facie, made out a case to be released on pre-arrest bail.

7. The petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the
