Petitioner is not named in the First Information Report and according to prosecution case itself, the informant happens to be an eye witness and claims that it was Ramayan Chaudhary, who gave dagger blows to the deceased. The name of the petitioner came in this case in course of investigation in the confessional statement of co-accused Ramayan Chaudhary but submission on behalf of the petitioner is that prior to the institution of the present case, the mother of the petitioner had lodged Kateya P.S. Case No. 93 of 2011 against co-accused Ramayan Chaudhary and others and, that is why, co-accused Ramayan Chaudhary falsely implicated the petitioner in the present crime.
