JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-03-2019 This is an application for grant of anticipatory bail in connection with Karamchat P.S. Case No. 57 of 2018, disclosing offences under Sections 147, 148, 149, 341, 324, 326, 307 of the Indian Penal Code and Section 27 of the Arms Act. Later on added Section 302 of the Indian Penal Code.
Allegation as per F.I.R. is that while the informant along with one Anil Chaudhary was going to the village Sabar and reached near village Aamaon, then six miscreants came on 3 motorcycles and they abused the informant and quarreled with him and one of them fired due to which Anil Choudhary received injury, who later on died.
Submission of learned counsel for the petitioner is that the petitioner is not named in the F.I.R. and later on, on the
Patna High Court CR. MISC. No.3368 of 2019(3) dt.08-03-2019 2/2 C.D.R. location some accused persons have been named and further on the information of Spy, the petitioner has been named in this case and nothing specific has been attributed against the petitioner. Further, he has no criminal antecedent. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Karamchat P.S. Case No. 57 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is further subject to the condition that the petitioner shall cooperate in the investigation of the case. (Vinod Kumar Sinha, J) Amjad/- U T
