Mr. Ajit Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 07-09-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 8(c), 20(b) (ii) (B), 29 of the Narcotic Drugs and Psychotropic Substances Act. 150 grams of brown sugar like substance was recovered from possession of two persons. One of that has already been allowed bail by a co-ordinate Bench of this Court in Cr. Misc. No. 17924 of 2021 for the reason that recovered quantity was less than commercial quantity, as such, the bar under Section 37 of the N.D.P.S. Act was not applicable and there was evident non-compliance of the requirement of Section 42 of the N.D.P.S. Act.

Considering the facts aforesaid and competition of

Patna High Court CR. MISC. No.12730 of 2021(3) dt.07-09-2021 2/2 investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Dighalbank P.S. Case No. 82 of 2020 giving rise to Special Case No. 11 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
