JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 15-04-2015 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner has renewed his prayer for bail in connection with Excise Case No.52 of 2010, corresponding to Tr. No. 1839 of 2014 registered under sub-sections (a) and (f) of Section 47 of the Excise Act.
The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 22nd September, 2014 passed in Cr.Misc. No. 33691 of 2014 with the following observations :- "Since the petitioner is in custody, the Magistrate concerned is directed to hold the trial on day-to-day basis and conclude the same as early as possible preferably within six months from the date of receipt/production of a copy of this order,
Patna High Court Cr.Misc. No.13824 of 2015 (2) dt.15-04-2015 2/2 failing which the petitioner would be entitled to renew his prayer for bail."
It has been contended that though the petitioner is in custody since 4th July, 2014 but till date only charges have been framed.
Regard being had to the observations made in the order dated 22nd September, 2014 passed in Cr.Misc. No. 33691 of 2014, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.D.Bharti, Judicial Magistrate, Chapra in connection with Tr. No. 1839 of 2014 arising out of Excise Case No. 52 of 2010. (Ashwani Kumar Singh, J) Pradeep/- U T
