JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 31-01-2019 This appeal is for grant of pre-arrest bail to the appellant against the order dated 4.12.2018 passed by Additional Sessions Judge-I, Bhojpur, Ara, in ABP No. 1838 of 2018 by which learned Special Judge has rejected prayer for pre-arrest bail of the appellant, who has been made accused in Ara Nawada P.S.Case No. 743 of 2018, registered under Sections 341, 504, 354 of the Indian Penal Code and Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Allegation against appellant is of entering inside the house of the informant and try to outrage her modesty, abusing her by caste name and also of assaulting and threatening her.

Submission of learned counsel for the appellant is that he is neighbour of the informant and whole allegation is false and concocted. Heard learned Special P.P.

Having heard both sides and in view of allegation, I am not inclined to grant privilege of anticipatory bail to the appellant, rather he

Patna High Court CR. APP (SJ) No.341 of 2019 dt.31-01-2019 2/2 should surrender and pray for regular bail, which shall be considered ion its own merit, without being prejudiced by this order. Accordingly, this appeal is dismissed.
