The petitioner seeks regular bail in connection with Nawanagar P.S. Case No. 201 of 2019/ Ex/ G.R. No. 629/2019 for the offence punishable under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Amendment Act, 2018. The allegation is regarding recovery of 17.28 liters of illicit liquor from the motorcycle of the petitioner, apart from recovery of other quantities of liquor from other persons, who were apprehended by the police and search / seizure was made.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent

Patna High Court CR. MISC. No.1225 of 2020(2) dt.17-01-2020 2/2 and is languishing in custody since 26.11.2019. Having regard to the facts and circumstances of the case, considering the submissions advanced by the learned counsel for the petitioner, coupled with the fact that the petitioner is having a clean antecedent and is languishing in custody since 26.11.2019, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 2nd cum Special Judge Excise, Buxar in connection with Nawanagar P.S. Case No. 201 of 2019/ Ex/ G.R. No. 629/2019 (Mohit Kumar Shah, J) Tiwary/- U T
