2. The petitioner apprehends his arrest in connection with Nathnagar P.S. Case No. (5103036240390) (390 of 2024), registered for the offences punishable under Sections 30(a), 30(d), 41(1) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, total 51.500 litres of illicit country made liquor has been recovered from the house of coaccused Priyanka Kumari.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Co-accused namely Priyanka Kumari has disclosed the name of the petitioner. The petitioner has no concern with the

Patna High Court CR. MISC. No.2713 of 2025(2) dt.15-02-2025 2/2 alleged recovery. Petitioner has one criminal antecedent of similar nature in which he is on bail.

5. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts of the case and also no recovery is made from the possession of the petitioner, the prayer for anticipatory bail is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of court of learned District & Additional Sessions Judge-12-cum-Special Judge, Excise-2, Bhagalpur in connection with Nathnagar P.S. Case No. (5103036240390) (390 of 2024), subject to condition as laid down under Section 482 of the B.N.S.S.
