JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are languishing in custody since 24.1.2015 in a case registered for the offences punishable under Sections 372,373,366A,344,348,370(A)(I)/34 of the Indian Penal Code, sections 3,4 and 5 of Immoral Traffic Prevention Act and sections 3,5 and 9 of Protection of Children from Sexual Offences Act.

Raid was laid in the house of petitioner Rubi Tiwari on information to the police that sex racket is being run by the petitioners. From the house of petitioner Rubi Tiwari, three female namely, Rubi Devi, Kajal Kumari and Neha Khatoon along with one Hemant Kumar were apprehended. On enquiry being made

Patna High Court Cr.Misc. No.14946 of 2015 (2) dt.12-05-2015 2/2 Neha Khatoon stated that the petitioner Rubi Tiwari forced her for flesh trade and she further stated that she had some sexual relation with petitioner no. 2 Hemant Shukla.

It is submitted by the learned counsel for the petitioners that only on suspicion the raid was laid. Nothing has been seized from the place of raid nor the activities suggested that the flesh trade was going on during raid. It is further submitted that the investigation has already concluded.

Considering the nature of accusation and the period in custody, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge, Gopalganj in connection with Gopalganj Mahila P.S. Case No. 8 of 2015.
