JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It appears from perusal of the impugned order that name of this petitioner came in this case in confessional statement of co-accused.

Learned counsel for the petitioner submits that except the aforesaid confessional statement of co-accused as well as para91 of the case diary in which the statement of one witness has been incorporated by the investigating officer, there appears to be nothing against the petitioner. It is further contended by him that so far as para-91 of the case diary is concerned, the aforesaid witness stated before the investigating officer that he learnt the name of dacoits on the basis of conversations of the dacoits.

Patna High Court Cr.Misc. No.4045 of 2016 (2) dt.10-02-2016 2/2 Petitioner does not have any criminal antecedent and having more or less similar allegation, one co-accused has already been granted privilege of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran, Chapra in connection with Chapra Muffasil P.S. Case No. 225 of 2015.
