Heard learned counsel for the petitioner and learned A.P.P. for the State, Dr. Indiwar Kumari, who is virtually connected.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 316(2) and 318(4) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that he entered into an agreement with Bhanu Ram for constructing his house at the rate of Rs. 140 per square feet, further accused took an amount of Rs. 2,60,000/- for which a receiving was given and also took an amount of Rs. 42,600/- for which no receiving was given, it is next alleged that Bhanu Ram, despite receiving money, was demanding more money and

Patna High Court CR. MISC. No.4764 of 2026(2) dt.29-04-2026 2/3 did not complete the construction and even threatened to implicate him in a case relating to SC/ST Act. 4.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that in pursuance of an agreement, Bhanu Ram had taken contract of constructing the house of the informant and when he demanded his legitimate dues, the instant false case came to be instituted. It is also submitted that petitioner is an Assistant of Bhanu Ram. It is next submitted that Bhanu Ram had approached this Court seeking anticipatory bail by filing Cr. Misc No. 58837 of 2025 and the same came to be allowed by an order dated 9-9-2025. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection
