Learned counsel for the petitioner is expected to honour his undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioner is/are apprehending his/their arrest in connection with C.R. No. 112 of 2019, Tr. No. 3954 of 2019 for the offence registered under Sections 498A of the Indian Penal Code.
It is a case of cruelty and harassment to the Opposite Party no. 2 due to non-fulfillment of demand of dowry.
Patna High Court CR. MISC. No.6745 of 2020(7) dt.03-01-2022 2/2 Learned counsel for the petitioner submits that the petitioner is ready to keep the opposite party no. 2 with full dignity and honour.
On the other hand, learned counsel for the opposite party no. 2 submits that opposite party no. 2 is also ready to live with her husband peacefully.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his/their arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Darbhanga in connection with C.R. NO. 112 of 2019, Trial No. 3954 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. However, learned counsel for the petitioner is directed to give information to the opposite party no. 2 before filing the bail bonds in the court below.
