The petitioner is languishing in custody since 17.12.2014 in a case registered for the offences punishable under Sections 376/511 of the Indian Penal Code.

The prosecution case is that the dumb daughter-in-law of the informant indicated that this petitioner after entering into the room has misbehaved with her. Subsequently, the petitioner was caught on the spot.

It is submitted by learned counsel for the petitioner that petitioner is the co-villager of the informant and on suspicion the accusation has been levelled and the victim was not medically examined.

Patna High Court Cr.Misc. No.14211 of 2015 (3) dt.03-07-2015 2/2 This fact has not been controvered by the learned APP after going through the case dairy that the victim has not been medically examined.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Saran at Chapra in connection with Maker P.S. Case No. 111 of 2014.
